General terms of service

§ 1 General Provisions

The owner and operator of the ChinaGo.pl website (hereinafter referred to as the “Website”) is BLUESUITCASE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (NIP: 6772453064, REGON: 386055909), located at ul. Josepha Conrada 51, 31-357 Kraków (hereinafter referred to as the “Seller”).

Clients of the Website can include individuals of legal age, legal entities, and organizational units without legal personality (hereinafter referred to as “Clients”).

These Terms and Conditions define the rules for using the Website, the principles of placing and accepting orders, as well as the principles for the provision of electronic services offered by the Website. Every Client is obliged to comply with these Terms and Conditions from the moment they take any action aimed at placing an order. By placing an order, the Client confirms that they have read, accepted, and agreed to adhere to these Terms and Conditions.

The advertisements, price lists, promotions, and other information presented on the Website do not constitute an offer within the meaning of the Civil Code of April 23, 1964 (Journal of Laws 1964 No. 16, item 93, as amended). They are only an invitation to conclude a contract directed to the Client.

§ 2 Client Obligations

Every Client is obligated to:

  1. Provide full and truthful information to confirm their identity;
  2. Fulfill obligations towards the Seller;
  3. Use the Website in a manner that does not interfere with its functioning and complies with the law of the Republic of Poland and these Terms and Conditions;
  4. Refrain from submitting or transmitting content prohibited by law through the Website;
  5. Not commercially distribute intellectual property created as a result of orders executed by the Seller.

Significant violations of these obligations, in addition to legal consequences, may result in the temporary or permanent denial of access to the Website’s resources.

§ 3 Services Offered Through the Website

The Website offers Clients the ability to order the following services provided by the Seller:

  • Searching for the best offers for goods transport services provided by third parties;
  • Goods transportation;
  • Sourcing goods on the Chinese market according to Client specifications;
  • Purchasing goods on behalf of the Client;
  • Live interpretation during business meetings and document/material translation;
  • Researching the Chinese market;
  • Organizing the import of goods from the People’s Republic of China.

Orders can be placed in writing, via email, or through a form available on the Website. An order is considered accepted by the Seller upon the explicit confirmation sent to the Client via email or phone, provided the Client has read and accepted the General Terms of Agreements (click here). The Seller reserves the right to decline an order without giving a reason.

For orders related to goods purchases, the order must include a list of specific goods along with the quantity, detailed specifications, manufacturer’s name, and optionally a link to the manufacturer’s website and/or transaction portals (e.g., alibaba.com, 1688.com).

§ 4 Seller’s Obligations and Responsibilities

  1. The Seller is not liable for the actions of external entities handling goods transportation or for other such entities directly handling the goods. Specifically, the Seller is not responsible for delays in goods delivery, damage, theft, or loss of goods.
  2. In case of events that give rise to compensation claims against the entities mentioned in point 1, the Seller will promptly provide the Client with all necessary information to pursue such claims.
  3. The Seller commits to making optimal choices of service providers, considering costs and estimated delivery times.
  4. The Seller is not responsible for customs duties or other taxes related to the delivery of goods from outside the European Economic Area. The Client is solely responsible for determining whether the goods are subject to such obligations according to the regulations of the recipient’s country. The Client assumes all risks associated with incorrect legal assessments. The Seller is also not liable for goods confiscated by customs authorities.
  5. In the event of legal violations by the Client, the Seller will provide the Client’s data and all necessary information to the relevant authorities upon request.
  6. The Seller is not liable for damages resulting from interruptions or failures of the Website caused by external parties, external factors, or force majeure.
  7. The Seller is committed to conducting market analyses diligently, using its business experience.

§ 8 Copyright Protection

The content of the Website, particularly its graphical design, is unconditionally protected by the Copyright and Related Rights Act of February 4, 1994 (Journal of Laws 1994 No. 24, item 83, as amended).

No element of the Website may be reproduced or disseminated in any form without the consent of its owner.

Property copyrights for works created by the Seller as part of order execution do not transfer to the Clients.

Violation of the Website owner’s copyrights will result in legal consequences as defined by applicable law, including:

  • The Copyright and Related Rights Act of February 4, 1994 (Journal of Laws 1994 No. 24, item 83, as amended);
  • The Civil Code of April 23, 1964 (Journal of Laws 1964 No. 16, item 93, as amended);
  • The Act on Combating Unfair Competition of April 16, 1993 (Journal of Laws 1993 No. 47, item 211, as amended).

§ 9 Personal Data Protection

The administrator of Clients’ personal data is BLUESUITCASE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (NIP: 6772453064, REGON: 386055909), ul. Josepha Conrada 51, 31-157 Kraków (hereinafter referred to as the “Administrator”).

  1. The Administrator ensures compliance with the law regarding the processing of personal data of Clients and other Website users (hereinafter referred to as “Users”).
  2. The Administrator processes Users’ personal data based on their consent and in connection with the Seller’s legitimate interests.
  3. Users’ consent to personal data processing is voluntary and can be withdrawn at any time.
  4. For order fulfillment, the following personal data of Clients (individuals) may be processed:
    • Name and surname;
    • Correspondence address;
    • Date of birth;
    • PESEL number;
    • Phone number;
    • Email address;
    • IP address;
    • Location;
    • Operating system of the computer/phone;
    • Browser type.
  5. To ensure full Website functionality, the following data of non-Client Users may be processed:
    • IP address;
    • Location;
    • Operating system of the computer/phone;
    • Browser type.

§ 10 Final Provisions

  1. The current version of the Terms and Conditions is available on the Website.
  2. None of the provisions of these Terms and Conditions aim to infringe on Clients’ rights. In the event of any inconsistencies with applicable law, the Seller will comply with the law instead of the contested provision.
  3. The Seller reserves the right to introduce restrictions to the Website due to maintenance work. The Seller will make every effort to minimize inconvenience caused by such restrictions.
  4. In case of disputes, the Seller and the Client will take steps to resolve them amicably.
  5. The Seller reserves the right to modify these Terms and Conditions at any time. Changes will not infringe on rights acquired by Clients under previous versions. Registered Clients will be notified of changes via email at least 30 days before they take effect. Other Users will be informed through a Website announcement.
  6. The court competent to resolve disputes is the court of the Seller’s registered office.
  7. Matters not regulated by these Terms and Conditions are governed by the applicable Polish law, particularly the Civil Code of April 23, 1964 (Journal of Laws 1964 No. 16, item 93, as amended).

These Terms and Conditions come into effect on May 6, 2020.
